Parking terms and conditions

1. Definitions

  1. “us” “we” and “our” means the Scottish Ministers acting through Forestry and Land Scotland (FLS) and includes any representative appointed as its agent.
  2. “you” means the driver, the passengers and the legal owner of the vehicle.
  3.  A ‘vehicle’ is defined as any motorised and wheeled device used for transporting visitors.
  4.  A “car” is defined as having 7 seats or less.

2. Contract

By parking in this car park you acknowledge that you enter into a contract with us on the basis of these Terms and Conditions.

3. Liability

FLS does not accept liability for any loss or damage to vehicles or their contents.

4. Tariffs

The parking fees payable at this car park are displayed on the tariff panels within the car park.

5. Parking tickets

5.1 Parking tickets are issued per individual vehicle accessing the site and are not transferable. Camper vans, car plus caravan, car plus trailer and HGVs will all be subject to the same tariff as a car. Coaches and minibuses are subject to a separate charge.

5.2 In the car park you must do one of the following;

  1. Purchase an appropriate parking ticket and ensure that the parking ticket is clearly displayed in the windscreen of the vehicle or where available purchase by pay by plate/phone/online for checking;
  2. Clearly display a valid parking pass for the car park in the windscreen of the vehicle; OR
  3. Clearly display your Blue Badge.

6. Parking Contraventions

6.1 It is important to the effective management of the car park that you park within an appropriate parking bay where provided, park
without causing obstruction or inconvenience to others, comply with all signs in the car park, pay the applicable parking fee and
display a valid parking ticket, badge or pass where applicable

6.2 The following constitutes a Parking Contravention:

  1. Parked without displaying a valid parking ticket, parking pass or Blue Badge
  2. Parked without paying the pay by plate/phone/online parking fee where available
  3. Parked after parking session has expired

6.3 Where a Parking Contravention occurs, a Parking Charge Notice will be issued.

7. Parking Charge Notice

7.1 The Charge for a Parking Charge Notice is a maximum of £50. If payment of the Parking Charge Notice is made within 72 hours of issue the charge will be reduced to a maximum of the day tariff of the car park. If payment of the Parking Charge Notice is made between 72 hours and 14 days of issue, the Charge will be reduced to a maximum of £25.

7.2 If payment of the Charge is not made within 28 days, further charges in connection with recovery may apply.

7.3 All payments in respect of Parking Charge Notices should be made to Forestry and Land Scotland. Details of how to make a payment are noted on the Parking Charge Notice.

7.4 If payment of a Parking Charge Notice is not made, then Forestry and Land Scotland reserves the right to take further legal steps
to recover payment from you.

8. Appeals

8.1 To appeal against your Parking Charge, please write to Visitor Services, Forestry and Land Scotland, Great Glen House, Leachkin Road, Inverness IV3 8NW

8.2 When lodging an appeal, you must include the following information:

  1. The Parking Charge Notice Number;
  2. The location of the Parking Charge Notice;
  3. Your vehicle registration number;
  4. Your reason for appeal; and
  5. Any evidence you may have in support of your reason for appeal.

9. Enforcement

9.1 By parking in this car park, you consent for the purpose of parking control and enforcement of these Terms and Conditions to the capturing of photographs of your vehicle and registration by the attendant and to the processing of this data, together with any other data provided by FLS approved agents in order to request registered keeper details from the DVLA.

9.2 Access to this car park is allowed at our absolute discretion. Where it appears to us that you have repeatedly and persistently acted in breach of these Terms and Conditions, including (but not limited to) repeated non-payment of a Parking Charge Notice, we reserve the right to take further legal action to prohibit you from accessing this car park, and to recover from you the cost of doing so.

10. General

FLS may vary or change these Terms and Conditions from time to time. Each of these Terms and Conditions shall be construed separately, applying and surviving even if for any reason other provisions are held inapplicable or unenforceable in any circumstances.

Annual Parking Pass terms and conditions
  1. FLS Parking Annual Passes are valid for 12 months from date of purchase via RingGo (RingGo terms and conditions apply) or at Glentress via the onsite payment machines (card only). Passes sold via Regional Offices (manual passes) will be dated for 12 months and one week to allow for delivery time following payment.

  2. Annual Passes are valid for a maximum of 2 vehicles per address. Both vehicles registrations will be included on the one manual pass. The RingGo account holder must change the vehicle registration themselves via their RingGo account. Glentress Pass holders must contact enquiries.south@forestryandland.gov.scot to add a second vehicle.

  3. An Annual Parking Pass application form needs to be completed and payment taken in full before a manual pass is issued. Application forms (online or paper-based) will be stored for 18 months before being securely destroyed in case of a lost or stolen pass or updating of vehicle details. An application form is not required for a pass purchased via RingGo or via the Glentress payment machines.

  4. FLS reserves the right to review and update the parking pass fee structure and terms and conditions at any time.

  5. Lost or stolen manual passes can be replaced for a £10.00 administration fee (Tentsmuir £20.00). The replacement pass will be issued with the same expiry date as the original pass and for the same vehicle.

  6. If you change your vehicle, a new manual pass can be issued on return of your current manual pass. The RingGo account holder must change the vehicle registration themselves. To change your vehicle registration on your Glentress pass please contact enquiries.south@forestryandland.gov.scot

  7. Pass miss-use – Annual Parking Passes provide parking for the Annual Pass holder ONLY. Should FLS become aware that the pass has been transferred to another vehicle owner to use, the Annual Pass will be terminated and no further passes issued for the same address or the holder’s vehicle excluded from the car park.

  8. Car park opening times – car park opening times and site facilities vary from site to site and can be closed at short notice due to weather conditions, essential forestry works or large events. Please visit forestryandland.gov.scot/visit for further details and before you travel. Purchase of an Annual Parking Pass does not guarantee availability of parking at any site. Parking is on a first come first served basis and car parks may become full at peak times.

  9. Annual Parking passes are for day-time parking only. Parking overnight is not permitted in most car parks.

  10. Tentsmuir car park in Fife has an electronic barrier system and therefore visitors wishing to purchase an Annual Parking Pass for Tentsmuir will require a barrier pass as well and should contact enquiries.east@forestryandland.gov.scot at least 7 days prior to visiting Tentsmuir.

  11. The terms and conditions of parking and parking enforcement are displayed on our onsite signage and at forestryandland.gov.scot/parking and comply with The British Parking Association Code of Conduct.
Glentress parking terms and conditions

  4. A “car” is defined as having 7 seats or less.

2. Contract

By parking in this car park you acknowledge that you enter into a contract with us on the basis of these Terms and Conditions.

3. Liability

FLS does not accept liability for any loss or damage to vehicles or their contents.

4. Tariffs

The parking fees payable at this car park are displayed on the tariff panels within the car park. if you do not wish to park, please exit the car park within 30 minutes.

Parking tickets are issued per individual vehicle accessing the site and are not transferable. Camper vans, car plus caravan, car plus trailer and HGVs will all be subject to the same tariff as a car.

Coaches and minibuses are subject to a separate charge.
In the car park you must do one of the following;

  1. Pay for the time you have parked before exiting;
  2. Clearly display a valid parking pass for the car park in the windscreen of the vehicle;
  3. Clearly display your Blue Badge; or
  4. Enter a discount code for discounted or free parking.

5. Parking Contraventions

5.2 The following constitutes a Parking Contravention:

  2. Parked after a valid parking pass or Blue Badge has expired;
  3. Exiting without paying the correct tariff; or
  4. Exiting without entering a valid discount code
